THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, DELTAFORM DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. 

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. 

 

7. Limitation of Liability 

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL DELTAFORM OR ITS AFFILIATES, DIRECTORS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DELTAFORM’S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE SHALL NOT EXCEED CAD $100 OR THE AMOUNT YOU PAID TO ACCESS THE SITE (IF ANY), WHICHEVER IS GREATER. 

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. 

 

8. Indemnity 

You agree to defend, indemnify, and hold harmless Deltaform and its affiliates from and against claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to your violation of these Terms or misuse of the Site.

10. Governing Law and Venue 

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles. 

You agree that courts located in Alberta will have exclusive jurisdiction over disputes arising from or related to these Terms or the Site. 

 

11. Changes to the Site or Terms 

We may change or discontinue any part of the Site at any time without notice. We may also update these Terms by posting a revised version on this page. Your continued use of the Site after changes become effective constitutes acceptance.
